1. Scope

These Terms of Use apply to the iPhone app “FastingFibi” (the “App”) and your subscription. The provider is Lukas Zimmermann, Clara-Schumann-Str. 15, 74889 Sinsheim, Germany (the “Provider” or “we”). You can read and save these Terms of Use on the subscription screen before you buy, at any time in the App under Settings > Terms of Use, and at fastingfibi.com/en/terms.

The App is intended exclusively for people aged 18 and over. By using the App, you confirm that you are at least 18 years old.

For apps obtained through the Apple App Store, Apple’s standard end user license agreement (Licensed Application End User License Agreement) also applies: Apple Standard EULA.

2. Description of services

FastingFibi supports you with intermittent and extended fasting and mindful eating. The App offers:

  • a fasting timer with various fasting intervals, a weekly plan and reminders
  • extended fasting (24 hours or longer) with phase display, water and symptom log and guidance on breaking a fast
  • weight history, calorie and macronutrient goals and an illustrative weight projection
  • a food log with manual entry, barcode scanning (data from Open Food Facts) and optional AI estimates from a photo, voice or text (only with your consent; the results are estimates)
  • medication reminders and a dose log (no dosing recommendations)
  • a journal with mood, notes and tags
  • statistics and insights
  • Apple Health integration (body weight only), widgets and a Live Activity
  • community features (optional, with an account)
  • cloud sync (optional, with an account)

After setup, using the App requires an active subscription (see Section 5).

Technical requirements: an iPhone running the iOS version stated in the App Store and an Apple ID. You need an internet connection for the account, cloud sync, community, AI analysis and barcode lookups. The App is available in German and English.

Updates: During your subscription, we provide the updates needed to keep the App in conformity with the contract, including security updates (Section 327f of the German Civil Code, BGB). You receive them through the App Store.

Changes to the App: Beyond necessary updates, we only change the App for a valid reason, for example new iOS versions, changed interfaces of our service providers, security reasons, new legal requirements or to develop the App further. This doesn’t cost you anything extra, and we inform you about the change clearly and understandably. If a change impairs your access to the App or its usability more than insignificantly, we inform you in good time beforehand on a durable medium, for example by email. You can then end the contract free of charge within 30 days (Section 327r BGB).

3. Important health notice

⚠️ The App does not replace medical advice, diagnosis or treatment. Intermittent and extended fasting are not suitable for everyone.

Before starting a fast or changing your diet, be sure to talk to a doctor, especially if you:

  • have pre-existing conditions (e.g. diabetes, heart, kidney or liver disease)
  • take medication, especially insulin or other blood-sugar-lowering drugs
  • are pregnant or breastfeeding
  • are underweight
  • have or have had an eating disorder

The information on fasting phases, calorie and nutrient needs, weight trends, water needs and breaking a fast is general information and estimates. You can find sources and calculations under Settings > “Sources & calculations”. AI estimates of nutritional values can be wrong; check the results. The safety questions in onboarding make sure the App doesn’t offer you unsuitable types of fasting; they don’t replace a medical assessment. Never change prescribed medication because of the App.

Stop a fast and get medical help if you notice warning signs, for example a racing heart, severe dizziness, confusion or persistent vomiting. In an emergency, call the emergency number (112 in the EU).

Whether and how you fast is your own decision. Our liability is governed by Section 8.

4. Registration and user account

You don’t need a user account to use the App. Cloud sync and the community require free registration. You sign in with Apple, Google or a sign-in link sent by email; there is no password.

An account is for you personally. Protect access to your Apple or Google account and your email inbox, because that is how you sign in. If you suspect misuse, please email us right away at [email protected].

5. Subscription and free trial

After onboarding, the App can only be used with an active subscription (“FastingFibi Premium”). You purchase the subscription as an in-app purchase through the Apple App Store; Apple bills it through your Apple ID. Apple’s terms also apply to the purchase.

  • Subscription periods and prices: You see the available periods (monthly or yearly) and prices including sales tax/VAT in the App and in Apple’s purchase dialog before you buy. The price shown in Apple’s purchase dialog is decisive.
  • Free trial: If offered, the subscription starts with a free trial (e.g. 7 days); you pay nothing during the trial. Unless you cancel at least 24 hours before it ends, it automatically converts into a paid subscription, which is charged at the end of the trial. A trial can only be used once per Apple ID. Any unused portion of the trial is forfeited if you purchase a subscription during it. If you allow the App to send notifications, Fibi reminds you two days before the trial ends; without this permission, there is no reminder.
  • Automatic renewal: The subscription automatically renews for the selected period unless you cancel it at least 24 hours before the end of the current period. The renewal is charged to your Apple ID within the last 24 hours before the current period ends.
  • Cancellation: You can cancel at any time in your Apple ID settings under “Subscriptions”, or directly from the App under Settings > Cancel subscription. Cancellation takes effect at the end of the current period; you keep access until then. Deleting the App or your account does not end a subscription.
  • Withdrawal and refunds: For purchases in the EU, Apple grants a 14-day right of withdrawal under its terms. You request withdrawal and refunds from Apple at reportaproblem.apple.com or in the App under Settings > Withdraw from contract. Other refunds are subject to Apple’s policies. Your statutory rights remain unaffected.
  • Price changes: Apple informs you of price changes in advance; where required, Apple asks for your consent.

6. Community guidelines and moderation

When you use the community, you agree:

  • not to publish offensive, discriminatory or unlawful content
  • not to give medical or false health advice, and not to spread content that glorifies or gives instructions for eating disorders, extreme diets or dangerous fasting practices
  • not to publish other users’ personal data
  • not to send spam or advertising
  • to treat other users with respect
  • to publish only content you have the necessary rights to, and not to share other members’ content outside the App

Usage rights: Your posts belong to you. You grant us the simple, free-of-charge right to store your posts, replies, reactions and check-ins and to show them to the members of the group in the App, as far as the community requires. This right ends when you delete the content or your account. We don’t use your posts for advertising or to train AI models.

Reporting and moderation: You can report any post (press and hold) and block people. We usually review reports within 24 hours. An automatic word filter blocks posts, group texts, bios and usernames containing blocked terms. Content that three different people report is hidden automatically until we have reviewed it. There are no other automated decisions.

If you break the rules, we can remove content, warn you and suspend your community access temporarily or permanently. The measure depends on how serious the violation is. Your subscription and the rest of the App are not affected unless Section 10 applies. We inform you of any measure by email, with a statement of reasons. You can contest it at [email protected]; we will then review the decision again. You can also report illegal content by email to [email protected].

7. Intellectual property

All rights to the App, including design, code, graphics, mascot and texts, lie with the Provider or its licensors. For the duration of your subscription, you receive the simple, non-transferable right to use the App for your own non-commercial purposes. Copying, modifying or distributing the App beyond what the law permits is not allowed. The App contains open-source components that are subject to their own licenses. Product data comes from Open Food Facts and is licensed under the Open Database License (ODbL).

8. Warranty and liability

Warranty: The statutory rules for digital products apply to defects in the App (Sections 327 et seq. BGB). We strive for high availability of the cloud features. Maintenance, outages at Apple, Supabase or other service providers and your internet connection may temporarily limit use. The timer, journal, nutrition without AI and reminders also work offline.

Liability: We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. In cases of simple negligence, we are only liable if we breach an essential contractual obligation, meaning an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose fulfillment you may regularly rely. In that case, liability is limited to the typical, foreseeable damage. Otherwise, liability for simple negligence is excluded. Mandatory statutory claims, for example under Art. 82 GDPR, remain unaffected.

Backups: Without an account, your data is only on your device; we recommend regular device backups. With an account, we back up the data listed in the privacy policy in the cloud.

9. Privacy

How we process your personal data is described in our privacy policy (in the App under Settings > Privacy Policy and at fastingfibi.com/en/privacy). We ask for consent, for example to the AI analysis, separately from these Terms of Use.

10. Termination

You can stop using the App at any time by deleting it. This does not end an active subscription; cancel it as described in Section 5. You can delete your account in the App under Settings > “Delete account & cloud data” or by email to [email protected].

We may terminate the user agreement for good cause without notice (Section 314 BGB), in particular for serious violations of these Terms of Use or violations repeated despite a warning, for misuse of the community or the AI features, or for unlawful use. A prior warning is only unnecessary if it would be futile or special reasons justify immediate termination. Your statutory rights, in particular to a refund of amounts already paid, remain unaffected.

11. Changes to the Terms of Use

We only change these Terms of Use when necessary, for example because of changes in the law or case law, to close gaps or to cover new features. Editorial changes that don’t disadvantage you (e.g. contact details, spelling, references) apply once published in the App.

We present all other changes to you in the App for your approval at least four weeks before they take effect. If you don’t agree, the previous terms continue to apply to you until the end of your current subscription period; we may then terminate the contract at that time. Silence or simply continuing to use the App does not count as approval.

12. Final provisions

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer whose habitual residence is in another country, you keep the protection of the mandatory consumer protection laws of that country (Art. 6(2) of Regulation (EC) No 593/2008, Rome I).

The statutory places of jurisdiction apply to disputes.

If individual provisions of these Terms of Use are invalid, the remaining provisions remain valid. The invalid provision is replaced by the statutory rules.
